<p>Erik Ortega is going to get a link from me for <a href="http://mytrifilliatepaydayreview.com/">TriFilliate PayDay</a> as he left a comment with a link to his review.</p>
<p>The reasons why I am mentioning this?</p>
<p>I think Erik represents the &#8220;good&#8221; human side of affiliate marketing and is learning his lessons well, and working hard. His affiliate blog is obviously wrtten by a person, not &#8220;admin&#8221;, has a privacy statement, and real about page which discusses why he is promoting the product as an affiliate, and lots of content.</p>
<p>But this also gives me the opportunity to offer a few tips.</p>
<p>It would be fairly easy to add some kind of disclosure statement in the sidebar about affiliate status, and depending on geographical location there might be a need for more contact details such as a P.O. box.</p>
<p>First link priority &#8211; Erik didn&#8217;t abuse my comment policy, but his second link with anchor text wouldn&#8217;t have counted, even if he had enough comments on my blog to get followed links, because there was already a link to the resource in his name field (where he used his name)</p>
<p>Email address &#8211; The email address used was for the new website &#8211; that might close some doors for spying out some of his other properties, but there are other ways to do that anyway, as I am sure he has multiple sites on the same domain, maybe common use of adsense etc.<br />
However by not using a consistant email address over time, it is hard to build up a reputation on blogs like mine which enable dofollow links after a period of time, or after a certain number of comments.</p>
<p>The best practice, to be 100% above board?</p>
<ul>
<li>Always use a consistant email address</li>
<li>Establish a real identity &#8211; gravatar etc</li>
<li>Always use your name in the name field</li>
<li>If your comment is just in response to a post, and won&#8217;t include a link to a resource, then you can justifiably link to your favorite money site (or maybe a pumper) as long as it is high quality and obviously yours (like Erik&#8217;s is)</li>
<li>If you are going to include a resource, then for the name field link it is best to use a totally different domain, or at least link to the root domain there and use a deep link to real solid relevant content within the comment body</li>
</ul>
<p>Including a link in the content you really need to be on target with a resource that is without doubt relevant to the conversation, something that if not mentioned would reduce the value of the discussion.</p>
<p>Quite often any link drop within the content will be held for moderation even on blogs where you have an existing high quality profile and reputation, so it must be up to human scrutiny.</p>

<li>This was pre-written email copy supplied to JV partners as I have seen this email sent by 2 different unrelated email lists.</li>
<li>The links in the email I added square brackets and are in bold like<strong> [this is a link]</strong></li>
<li>The deceptive headline did get me to open it, but a smart copywriter would have added some truth to the content</li>
<li>The links proclaim a blog post</li>
<li>You click the links and end up on a sales page</li>
<li>The sales page itself is full of elements that are probably extremely dodgy now, and the biggest insult is probably the fake &#8220;trust marks&#8221;.</li>

<p>If someone is using fake trust marks, would you:-</p>

<li>Believe their income claims?</li>
<li>Actually trust them in any way?</li>
</ul>
<p>Notice any similarities between legitimate trust marks provided by Trust Guard, and the fake ones?</p>

<p>That is an affiliate banner, and I have chatted with Garrett the affiliate manager in the past regarding my larger project. Trust Guard is one of the most affordable legitimate trust mark providers, and possibly the cheapest for things like PCI compliance though it has been a while since I did my research.<br />
If you like what they offer, do your own due diligence and end up becoming their customer, there is a small chance if you haven&#8217;t cleared your cookies and the tracking works and countless other potential problems, that I might earn an affiliate commission.</p>
<p>Oh, and I have just lost trust in the people who sent me the email, and the chances of me promoting one of their products in the future, or even remaining on their email list are remote.</p>
<p><strong>I wouldn&#8217;t want my readers to be sent dishonest emails if I referred them and they ended up on their list.</strong></p>
<h2>Real FTC Commentary From Marketers</h2>
<p>There has been lots of coverage on technology blogs and &#8220;social media maven&#8221; blogs but I just want to highlight a few I have read you might have missed.</p>
<p>Michel Fortin has some great commentary about <a href="http://www.michelfortin.com/affiliate-marketing/">testimonials and vendor liability</a> for the actions of affiliates.</p>
<p><a href="http://fashionista.com/2009/10/yesterday_the_federal_trade_co.php">The FTC&#8217;s Feebie Rule on Fashionista</a> &#8211; included because sometimes I get free samples to review, and free samples I don&#8217;t end up having time to even look at, or find unsuitable. I also sometimes get free access to things based upon previous affiliate performance. I used to work in the games industry &#8211; do you think logos of hardware manufacturers end up on product boxes without some quid pro quo?</p>
<p>How much are PC adverts subsidized if they include Intel and Microsoft logos? How do they disclose the financial arrangements of pre-installed sample software?</p>
<p>Testimonials&#8230; does it really change how they look on a page to add disclaimers. Have a look <a href="http://www.imleadership.com/">at this sales page</a> Howie just posted for one of his programs and look at all the disclaimers in the testimonial boxes. I am not using an affiliate link and am linking because it is the first example I have seen since the new rulings&#8230; I am not sure this is the best method &#8211; I think a &#8220;speech bubble&#8221; on mouse over might work better.</p>
<p>John points out us <a href="http://blog.fcon21.biz/274/regulations-advertisers-in-usa-and-eu-should-know-about-ftc-and-european-commission/">Euros have had to live with this quite a while</a> (I have covered it a lot myself in the past) along with some sound tips &#8211; I suppose I should disclose that John leaves great comments and has been known to tweet my articles.</p>
<p>Don&#8217;t forget my old post defining 32 kinds of <a href="http://andybeard.eu/803/linking-payola.html">Blogging and Linking Payola</a> &#8211; the FTC should really have addressed every form and more &#8211; I probably only covered half of them.</p>
<p>Lets finish up with a question&#8230; if I updated my old <a href="http://wordpress.org/extend/plugins/disclosure-policy-plugin/">disclosure policy plugin</a> to work with current versions of WordPress, would anyone actually use it? (well I know a few people who might for monetization as it was really effective)<br />
I have had a few enquiries, and the download stats over the last few years suggest there may even be people using it still, though it only supported up to WP2.2 officially.<br />
The plugin was contextual so now for instance <a href="http://www.mattcutts.com/blog/disclosure/">Matt Cutts has a full disclosure policy finally</a> he could add the plugin, and on every historical post where he mentioned Google, it could add a short disclosure with a link to a full disclosure policy, or even a specific disclosure policy about Google, both on the page and in his feed.</p>

<h3>The Rackspace Cloud Affiliate Program</h3>
<p>As far as I am aware, the Rackspace Cloud affiliate program is effectively &#8220;customers only&#8221;, as in you have to actually create an account, but you don&#8217;t have to necessarily spend anything on their various cloud services.</p>
<p>That being said they have a decent Cloudfiles storage product, and their CDN is reasonably priced, offers incredible low latency, and has a strong API.</p>
<p>The Cloud Servers product is new, the API is still in beta, and on first glance looks to actually be more expensive than using the Slicehost sister service, but if you are looking to create a highly scalable platform, there are significant advantages.</p>
<p>The Mosso Cloudsites service is also highly regarded, though you have to be careful on processor cycles &#8211; for an affiliate the referral payout on Cloudsites is much more attractive, just a shame it isn&#8217;t monthly recurring.</p>
<h3>Problems With Rackspace Cloud Referral Program</h3>

If someone you refer to Cloud Sites hosts with us for at least 31 days (past their first billing cycle), we will either credit your account $100 or cut you a check for the same (if you want the check, just sign some tax information and that&#8217;s it). There is no need to register before participating, simply have any referral use the primary email address on your account as the &#8216;referral code&#8217; during the sign-up process online. <p><strong>One of the big problems is the referral code</strong> &#8211; you have to encourage people to enter your primary email address as a coupon code.</p>
<p>The obvious workaround is to create a new primary email address for your Rackspace account (and display it as an image)</p>

<p>It would be so much easier if you could define your own coupons</p>
<p><strong>The next problem is incentive</strong> &#8211; why would someone use my Rackspace referral code?</p>
<p>Rackspace do not currently offer their own incentive to use a coupon, so it would be down to an affiliate to offer something of significant perceived value as an added incentive.</p>
<p>I have something planned for that, that will only be available to people who sign up for a <a rel="nofollow" href="http://mosso.com">Rackspace Cloud account</a> using my email as a Rackspace coupon. (note: they are still using the mosso.com domain)</p>
<p>I currently have no idea how to make delivery of bonuses scalable, as there doesn&#8217;t seem to be a reporting interface for affiliates in the current control panel &#8211; maybe they have a dedicated affiliate panel as well, under their original Rackspace affiliate program.</p>
<h3>Added Friction</h3>
<p>Rackspace might think that not running a formal affiliate system, and just using email addresses somehow removed friction from the referral process, but in many ways it adds friction for serious affiliates.</p>
<p>80% of new customers will be referred by only the top 20% of affiliates, it might even be 90/10 or 95/5</p>
<h3>Not Suitable For PPC</h3>
<p>There is no way to effectively track this affiliate program offering</p>
<ul>
<li>no subids</li>
<li>no deep linking</li>
<li>no way to export data (that I can see)</li>
<li>no thought to integration marketing</li>
</ul>
<h3>Disclosure</h3>
<p>This Rackspace marketing campaign seems totally unworkable, especially <a href="http://izea.com/universal-disclosure/">the direction disclosure is taking</a>.</p>
<p>I am sure <a href="http://scobleizer.com">Robert Scoble</a> will love the idea of his employers shilling for links.</p>
<p>Izea &amp; PayPerPost have more transparency and better disclosure than Rackspace in this new marketing campaign.<br />
That being said, I always wonder what benefits large blogs have when they frequently have followed links to their hosting providers. Sure they like the service, but that can&#8217;t possibly be the full monty.</p>

<h3>6 BANNED PRACTICES (SCHEDULE 1)</h3>
<p>(7) Falsely stating that a product will only be available for a very limited<br />
time, or that it will only be available on particular terms for a very limited<br />
time, in order to elicit an immediate decision and deprive consumers of<br />
sufficient opportunity or time to make an informed choice.</p>
<p>A trader falsely tells a consumer that prices for new houses will be<br />
increased in 7 days time, in order to pressurise him into making an<br />
immediate decision to buy.
</p></blockquote>
<p>That hits 50% or more of long page sales letters and many Product Launch Formula tactics such as closing the doors then reopening just a few days later after a &#8220;recount&#8221; of total sold.</p>
<p>How about those &#8220;slightly damaged&#8221; copies offers for physical products?</p>
<blockquote><p>(10) Presenting rights given to consumers in law as a distinctive feature<br />
of the trader&#8217;s offer.<br />
A stationer sells pens. He advertises on the following basis: &#8216;Pens for<br />
sale. If they don&#8217;t work I&#8217;ll give you your money back or replace them.<br />
You won&#8217;t find this offer elsewhere&#8217;. If the pen is faulty at the time of<br />
purchase the consumer would be entitled to a refund, repair or<br />
replacement under contract law. The trader&#8217;s emphasis on the unique<br />
nature of his offer to refund or replace would breach the CPRs.</p></blockquote>
<p>Careful when wording guarantees either as a merchant or affiliate</p>
<blockquote><p>(11) Using editorial content in the media to promote a product where a<br />
trader has paid for the promotion without making that clear in the<br />
content or by images or sounds clearly identifiable by the consumer<br />
(advertorial).<br />
A magazine is paid by a holiday company for an advertising feature on<br />
their luxury Red Sea diving school. The magazine does not make it clear<br />
that this is a paid-for feature â€“ for example by clearly labelling it<br />
&#8216;Advertising Feature&#8217; or &#8216;Advertorial&#8217;. This would breach the CPRs.</p></blockquote>
<p>It looks like disclosure in the content is becoming law for things like paid posts and reviews on blogs.</p>
<p>It could be argued that this also applies to affiliate links.</p>
<blockquote><p>(14) Establishing, operating or promoting a pyramid promotional scheme<br />
where a consumer gives consideration for the opportunity to receive<br />
compensation that is derived primarily from the introduction of other<br />
consumers into the scheme rather than from the sale or consumption of<br />
products.<br />
A trader operates a holiday club which offers consumers, on payment of<br />
a membership fee, the opportunity of earning large amounts of money by<br />
recruiting new members to the club. The other benefits of club<br />
membership are negligible compared to the potential rewards of earning<br />
commission for</p></blockquote>
<p>Pyramids, but this might also affect products sold as resale rights, especially if that is the only option, or closed affiliate programs.</p>
<blockquote><p>
(20) Describing a product as &#8216;gratis&#8217;, &#8216;free&#8217;, &#8216;without charge&#8217; or similar if<br />
the consumer has to pay anything other than the unavoidable cost of<br />
responding to the commercial practice and collecting or paying for<br />
delivery of the item.<br />
A trader advertises a &#8216;free&#8217; gift. He then tells consumers that in order to<br />
receive their &#8216;free&#8217; gift they need to pay an extra fee. This would breach<br />
the CPRs.
</p></blockquote>
<p>Careful how you word those bonuses, not only in your reviews or emails, but especially email headlines and Adwords.</p>
<blockquote><p>
(22) Falsely claiming or creating the impression that the trader is not<br />
acting for purposes relating to his trade, business, craft or profession, or<br />
falsely representing oneself as a consumer.<br />
A second-hand car dealership puts a used car on a nearby road and<br />
displays a handwritten advertisement reading &#8216;One careful owner. Good<br />
family run-around. Â£2000 or nearest offer. Call Jack on 01234 56789&#8242;.<br />
The sign gives the impression that the seller is not selling as a trader,<br />
and hence this would breach the CPRs.
</p></blockquote>
<p>Are you really just the average Joe making a fortune, or do you have an army of staff or outsources doing everything.</p>
<blockquote><p>(30) Explicitly informing a consumer that if he does not buy the product<br />
or service, the trader&#8217;s job or livelihood will be in jeopardy.</p></blockquote>
<p>If your house burns down, be careful how you word a firesale.</p>
<blockquote><p>
7 MISLEADING PRACTICES (REGULATIONS 5 AND 6)<br />
7.1 The CPRs prohibit misleading actions and misleading omissions (as<br />
detailed in regulations 5 and 6),16 which cause or are likely to cause the<br />
average consumer to take a different decision.<br />
7.2 A practice can mislead by action or omission or both. These prohibitions<br />
aim to ensure that consumers get from traders, in a clear and timely<br />
fashion, the information they need to make informed decisions relating<br />
to products. In addition, in some commercial practices (referred to as<br />
&#8216;invitations to purchase&#8217;) certain specific information must be given to<br />
consumers, unless apparent from the context.
</p></blockquote>
<blockquote><p>
7.6 These are actions that mislead by:<br />
â€¢ containing false information OR deceiving or being likely to deceive<br />
the average consumer (even if the information they contain is<br />
factually correct),17<br />
and<br />
â€¢ the false information, or deception, relates to one or more pieces of<br />
information in a (wide-ranging) list (see below),<br />
and<br />
â€¢ the average consumer takes, or is likely to take, a different decision<br />
as a result.
</p></blockquote>
<p>Which crappy traffic stats package are you using to inflate numbers?</p>
<p><b>Comments on the following are in bold inline:-</b></p>
<blockquote><p>
7.7 The list of information mentioned above includes the main factors<br />
consumers are likely to take into account in making decisions relating to<br />
products, for example the main characteristics of the product and the<br />
price or the way it is calculated. The full list follows:</p>
<p>(a) the existence or nature of the product<br />
<b><em>You really are just a simple guy, and not a marketer trying to sell his ebook written on Elance.</em></b><br />
(b) the main characteristics of the product<br />
<b><em>The whole truth, not the convenient truth</em></b><br />
(c) the extent of the trader&#8217;s commitments<br />
(d) the motives for the commercial practice<br />
<b><em>Does this afect loss-leaders, upsell, downsell process?</em></b><br />
(e) the nature of the sales process<br />
(f) any statement or symbol relating to direct or indirect sponsorship or<br />
approval of the trader or the product<br />
<b><em>Testimonials</b></em><br />
(g) the price or the manner in which the price is calculated<br />
<b><em>Include +VAT (Geotarget) on sales pages for Clickbank?</em></b><br />
(h) the existence of a specific price advantage</p>
<p><b><em>Are you split testing your pricing? This might affect you</em></b></p>
<p>(i) the need for a service, part, replacement or repair<br />
(j) the nature, attributes and rights of the trader or his agent<br />
(k) the consumer&#8217;s rights or the risks he may face.</p>
<p>The &#8216;main characteristics of the product&#8217; include:</p>
<p>(a) availability of the product</p>
<p><b><em>Thinking of using scarcity?</em></b><br />
(b) benefits of the product<br />
<b><em>Get 1,000,000 subscribers overnight</em></b><br />
(c) risks of the product<br />
<b><em>Did we forget to tell them about Google bans?</em></b><br />
(d) execution of the product<br />
(e) composition of the product<br />
(f) accessories of the product<br />
(g) after-sale customer assistance concerning the product<br />
(h) the handling of complaints about the product<br />
(i) the method and date of manufacture of the product<br />
(j) the method and date of provision of the product<br />
(k) delivery of the product<br />
(l) fitness for purpose of the product<br />
(m) usage of the product<br />
(n) quantity of the product<br />
(o) specification of the product<br />
(p) geographical or commercial origin of the product<br />
(q) results to be expected from use of the product<br />
(r) results and material features of tests or checks carried out on the<br />
product.</p>
<p><b><em>You need real proof&#8230;</em></b></p>
<p>The &#8216;nature, attributes and rights of the trader or his agent&#8217; include:</p>
<p>(a) identity<br />
(b) assets<br />
(c) qualifications<br />
(d) status<br />
(e) approval<br />
(f) affiliations or connections</p>
<p><b><em>Here is that disclosure thing again</em></b></p>
<p>(g) ownership of industrial, commercial or intellectual property rights<br />
(h) awards and distinctions.
</p></blockquote>
<blockquote><p>
Misleading Omissions (regulation 6)<br />
Giving insufficient information about the product<br />
7.12 Practices may also mislead by failing to give consumers the information<br />
they need to make an informed choice (in relation to a product). This<br />
occurs when practices:<br />
â€¢ omit or hide material information, or provide it in an unclear,<br />
unintelligible, ambiguous or untimely manner,<br />
and<br />
â€¢ the average consumer takes, or is likely to take, a different decision<br />
as a result<br />
7.13 A misleading omission can also occur where a trader fails to identify the<br />
commercial intent of a practice, if it is not already apparent from the<br />
context. The presence of a price, or of a statement making it clear that<br />
the practice is commercial (for example: &#8216;this is an advertisement&#8217;), are<br />
examples of how commercial intent could be made clear.<br />
OFT931 35<br />
7.14 When deciding whether a practice misleads by omission, the courts will<br />
take account of the context.18
</p></blockquote>
<p>Commercial intent = more disclosure</p>
<blockquote><p>7.33 Information that is deemed to be material in invitations to purchase is set<br />
out in regulation 6(4), which is summarised below:<br />
â€¢ the main characteristics of the product â€“ for example, what it is and<br />
what it does â€“ to the extent appropriate to the medium used by the<br />
invitation to purchase and the product<br />
â€¢ the identity of the trader, such as his trading name, and the identity<br />
of any other trader on whose behalf the trader is acting<br />
â€¢ the geographical address of the trader or traders</p></blockquote>
<p>The geographical address has been required since December 2006 (si3429)</p>
<p>The document goes on to cover such things as</p>
<ul>
<li>Professional Diligence</li>
<li>Material Distortion</li>
<li>Compliance and Enforcement covering</li>
<ul>
<li>education, advice and guidance</li>
<li>established means</li>
<li>codes of conduct</li>
<li>civil enforcement</li>
<li>criminal enforcement</li>
</ul>
</ul>
<p>This document covers business or &#8220;trader&#8221; to consumer regulations, and specific that this <b>does not cover business to business transactions</b> where the product is intended for ultimate business use. If a product is sold to wholesale, then on to a consumer, a lot of this still applies.</p>
<p>I have no idea how this applies to foreign traders doing business with the UK, or where they have a satellite office in the UK or Europe.</p>
<p>I am not a lawyer, and note that the <a href="http://www.oft.gov.uk/shared_oft/business_leaflets/530162/oft931int.pdf">linked document</a> is only guidance and not the full version.<br />
I may very well be reading into this more than the law intended, but this seems to compliment <a href="http://andybeard.eu/tag/si3429">SI3429</a> which has been largely ignored by many online businesses, and I assume isn&#8217;t enforced effectively for this to be the case over a year since publication.<br />
So far I have only spent a couple of hours on the 88 page document and this blog post (speed reading the key information I need). You should read the document in full to extract the information you need.</p>
<p>I know <a href="http://www.timnash.co.uk/contact/">Tim Nash</a> knows a few lawyers who specialise in this kind of thing.</p>
<h3>Update</h3>
<p>Tim has just published an overview of which <a href="http://paymentblogger.com/2008/04/14/legal-notices/">legal notices</a> you might be expected to publish on your site. It is aimed at people in the UK and possibly Europe and many such regulations are universal.<br />

<h3>Update 2</h3>
<p>It took a couple of weeks, but there now seems to be some mainstream online media attention to these new regulations.</p>
<p>Adage points out that this <a href="http://adage.com/digital/article?article_id=126667">came into force across Europe in January</a> though only goes into some of the most mainstream forms of WOMM.</p>
<p>Paid Content (UK) also <a href="http://www.paidcontent.co.uk/entry/419-word-of-mouth-advertising-online-gets-gagged/">focuses on the more corporate sector</a></p>
<p>Peter Parks has <a href="http://www.glasshousepartnership.com/blog/a-victory-for-transparency-in-consumer-trading/">condensed things down to lots of bullet points</a>.</p>
<p>Over on Daily Blog Tips, <a href="http://www.dailyblogtips.com/10-essential-legal-points-for-bloggers/">10 Essential Legal Points For Bloggers</a> covers other legal matters. I think Tims post is beter on legal paperwork, but it does cover a few other angles. It was written by lawyer <a href="http://www.imparl.com/">Steve Imparl</a> so has some level of credibility, I am going to have to delve into his blog archives to see if there is some more meaty content.</p>

<p>I honestly want to believe that you are a good internet citizen, and your attacks on search engine optimization and now affiliate marketers are honest, and without any form of prejudice.</p>
<p>So while you are attacking affiliate marketing, please ensure you have first of all cleared up all the problems in the paid links debate, such as what seems to be a company, where you are on the board of directors, <b>buying links</b>.</p>

<p>It is widely discussed that buying links in WordPress themes is something that might be a signal of web spam, and the same should be true for buying links in WordPress plugins and gaining millions of links.</p>

<p>Of all the default options within the original Sociable plugin, quite honestly the ThisNext button appearing by default is the least obvious choice, <a href="http://push.cx/sociable">thus most likely to have been paid for</a>.</p>
<p>When approached about making the links nofollow, the developer refused &#8211; he seemed to think all those links to forms were a deserved vote.</p>
<p>I took action, encouraging people to add nofollow initially, and then <a href="http://andybeard.eu/wordpress-plugin-hacks">releasing a modified version of the sociable plugin</a>.</p>
<p>That version is relatively unknown &#8211; only downloaded 1700 or so times, I am sure the original has been downloaded upwards of 100,000 times.</p>
<p>Recently Joost decided to take over development of <a href="http://wordpress.org/extend/plugins/sociable/">Sociable and create a new &#8220;official&#8221; version</a></p>
<p>I did make sure that the <a href="http://www.joostdevalk.nl/sociable-wordpress-plugin-take-over/#comment-28434">default options were changed</a>.</p>
<h3>Not As Bad As It Used To Be</h3>
<p>Fortunately this situation isn&#8217;t as bad as it used to be, otherwise I honestly wouldn&#8217;t raise it in so open a manner.</p>
<p>ThisNext now has someone on board or was made aware of this issue and has made a specific point to block the URL from search engines</p>
<p>Disallow: /pick/new/submit/</p>
<p>That may not be the case of the other default inclusions</p>
<p>But it is deceptive to users &#8211; those are purchased links, and there is no form of disclosure on the page that they are paid advertising.</p>
<p>For a long time those pages were not blocked</p>
<h3>Deja Vu</h3>
<p>These are really old conversations but highly relevant to the current</p>
<p>There have been extensive discussions regarding the <a href="http://andybeard.eu/2007/03/payperpost-ted-murphy-vs-jason-calacanis-the-ultimate-showdown.html">differences in disclosure in various blogging scenarios</a> including with Gordon Gould of ThisNext after the interview between Jason and Ted from Izea (formerly PayPerPost)</p>
<p><a href="http://andybeard.eu/2007/02/clickbank-require-disclosure-a-list-bloggers-totally-missed-the-point-in-december.html">Clickbank have required disclosure</a> for more than a year now, though they leave it to the FTC to decide what level of disclosure is required.</p>
<p>Google still <a href="http://andybeard.eu/2007/01/google-requiring-affiliates-not-to-declare-ftc-womma.html">prevent disclosure</a> of their referral units.</p>
<p>I have been writing about <a href="http://andybeard.eu/tag/disclosure">affiliate disclosure</a> for some time</p>
<p>When Jason asks <a href="http://www.calacanis.com/2008/02/29/will-the-ftc-ban-undisclosed-affiliate-links/">&#8220;Should Google, Yahoo, Mahalo, etc. ban affiliate links? (or &#8220;Will the FTC ban undisclosed affiliate links for us all?&#8221;)</a>&#8221; his first port of call should be companies where he has a say in what they do, then his friends at Google.</p>
<p>Jason should also look into other forms of <a href="http://andybeard.eu/2007/06/linking-payola.html">payola</a>, and his <a href="http://www.centernetworks.com/calacanis-affiliate-link-banning">own linking practice</a></p>

<p>All I have replaced is the word &#8220;money&#8221; with the word &#8220;payola&#8221; because not all forms of payola are monetary or immediately obvious, but it certainly can have huge value.</p>
<p>Feed readers and Ajax desktops get a huge amount of coverage on many popular tech blogs, probably a lot more so than any other online service. Every minor update to a major RSS platform gets coverage, and hell, I am not immune to this either.</p>
<p>There is a huge benefit in people creating accounts on multiple feedreaders, only to discard them at a later date. The feeds are still being pulled for your account, even if you haven&#8217;t logged into it for the last 6 months, and those subscriber numbers are still being reported to Feedburner.</p>
<p>But major blogs there is some additional payola that almost guarantees additional coverage</p>
<h3>Default Subscriber Packages</h3>
<p>Yes, I am jealous&#8230;</p>
<p>Not every feed reader service provides &#8220;suggested reading&#8221; and default packages, but many do, and it certainly has an effect on subscriber numbers for the major blogs.</p>
<p><b>Does something like this have an effect on coverage?</b></p>

<p>I wonder what percentage of subscriptions come from such default subscription packages&#8230;</p>
<p><strike>Google Reader currently has a huge market share, and doesn&#8217;t provide default subscription options. A lot of those subscribers are created by extensive coverage on Tech blogs, converting people over to Google Reader, or at least encouraging people to test out other services.</strike></p>
<p>There seems to be a huge disparity between subscriber growth rate for those included in such default packages, and those who are not.</p>
<h3>Duplicity</h3>
<p>This is a fun concept&#8230;</p>
<p>Tech sites frequently discuss market share for feed readers. They frequently compare numbers of their own subscribers by providing screenshots of their subscriber numbers.</p>
<p>Obviously it is important to figure as prominently as possible on such a list, so it makes huge financial sense to include the most prominent tech blogs within the default subscriber packages, even if more of your users would most likely be interested in a knitting blog or parenting.</p>
<p><b>Surely this should be something disclosed when talking about RSS applications?</b></p>

<p>I like to keep a fairly professional and level head when I am discussing various issues on this blog but unfortunately I have just listened to the pre-recording that <a href="http://www.shoemoney.com/2007/06/05/debating-blogging-disclosure-with-rand-fishkin-on-net-income/">Shoemoney did with Rand Fiskin</a> about full disclosure when blogging, and quite honestly whilst I empathise with some of the points both made, I think in many ways both are missing at least a few vital points.</p>
<p>Regular readers however are going to be shocked about this but in my opinion&#8230;</p>
<p><b>Shoemoney&#8217;s Disclosure Is Better Than Rand&#8217;s</b></p>
<p>I am calling it a debacle rather than a debate, because in a debate there is at least a serious attempt to do some fact gathering. Maybe there were time constraints both in the planning and the delivery, and it is good to see disclosure being discussed, but I honestly expected after the previous round of blog and counter-blog for there to be a more in-depth look.</p>
<h3>There Are Regulations For Bloggers</h3>
<p>Major companies such as <a href="http://andybeard.eu/2007/02/clickbank-require-disclosure-a-list-bloggers-totally-missed-the-point-in-december.html">Clickbank require disclosure</a>. As I pointed out in that article, they link through to the FTC regulations for Word of Mouth marketing.</p>
<p>How anyone can debate whether affiliates need to disclose without using the phrase &#8220;Word of Mouth Marketing&#8221; is just ridiculous.<br />
There is a big difference between a recommendation and an advert in the sidebar.</p>
<h3>It Is Not Who You Talk About, But Also What You Don&#8217;t Talk About</h3>
<p>Why don&#8217;t you rip apart <a href="http://andybeard.eu/2007/01/google-requiring-affiliates-not-to-declare-ftc-womma.html">Google on their referral units</a>, where they effectively prevent disclosure, whilst encouraging WOMM.<br />
I mentioned this again recently in my post regarding the <a href="http://andybeard.eu/2007/05/77-reasons-why-google-buying-feedburner-is-a-match-made-in-heaven-hell.html">Feedburner acquisition</a>.<br />
People don&#8217;t criticise Google because it would affect their relationship with Google.</p>
<p>On the other hand, bloggers seem more than happy to jump on the bandwagon for linkbait talking about services that don&#8217;t pay the bills.</p>
<h3>No Mention of Word of Mouth Marketing Association</h3>
<p>I have had issues with the <a href="http://andybeard.eu/2007/03/womma-should-watch-who-they-quote-and-especially-who-they-link-to.html">WOMMA and disclosure</a> in the past, but at least I acknowledge they exist.</p>
<h3>Disclosure Policy</h3>
<p>It isn&#8217;t hard to do &#8211; Shoemoney now effectively has a disclosure policy, Rand doesn&#8217;t. All he really needs to do now is stick a link to it in his sidebar, or even better add it in some way to his feeds using something akin to my disclosure policy feedflare, and everything is 100% above board and he can drop as many affiliate links as he likes without feeling compelled by anyone to stick a little (aff) after links which not all visitors would understand anyway.</p>
<p>As I noted recently, <a href="http://andybeard.eu/2007/05/letting-other-people-write-the-linkbait.html">John Reese is also using disclosure</a> for AuctionAds affiliate links, follow his lead, as John rarely puts a foot wrong.</p>
<h3>Shilling for Google and Yahoo? Grow Some Brass Ones</h3>
<p>Maybe not, but I think the majority of people writing about SEO and the search engines in general need to grow some brass ones, such as <a href="http://www.jackhumphrey.com/fridaytrafficreport/search-engine-optimization/yahoo-slurp-has-been-banned-from-ftr/">Jack Humphrey has just demonstrated</a>.</p>
<p>In fact lots of the blogs I have been reading up until recently on a regular basis seem to take no stance on major issues, and to just ask their reader&#8217;s opinions, or link out to people supporting their opinion, without actually stating it.</p>
<h3>Payola</h3>
<p>I deliberately didn&#8217;t link through to any particular article when I listed <a href="http://andybeard.eu/2007/06/linking-payola.html">32 kinds of linking Payola</a>. It is interesting that the podcast highlighted at least one more form, and possibly more.</p>

<p>A lot of the things I write go completely over the head of many of my readers, and in some ways that is actually a concious decision which certainly costs me a much higher readership.</p>
<p>I know that an article covering the <a href="http://www.yackyack.co.uk/2007/05/26/link-tips-are-you-linking-to-your-friends-in-a-useful-way/">importance of good anchor text</a> or <a href="http://www.doshdosh.com/niche-blogging/how-to-choose-the-right-blog-niche-a-simple-three-step-method/">choosing a niche</a> would help a lot of people, but I would much prefer to just link through to other people I respect who have written about the subject as well, or in many cases better than I would do myself.</p>
<p>I have discussed in the past that I don&#8217;t write <a href="http://andybeard.eu/2007/01/speed-linking-slow-linking.html">speed linking articles</a>, and for some reason, despite  how many hundreds or even 1000s of bloggers use speedlinking in their titles, or even have whole categories for such roundup link posts, I still rank highly for the term in Google.</p>
<p>Scott Jangro seems to be going through a similar dilemma to what I go through on an almost daily basis &#8211; stick to your <a href="http://www.jangro.com/a/2007/05/20/changing-things-up-around-here/">self defined niche</a>, or respond to the signals given to you by your traffic stats.</p>
<p>Vanessa Fox has saved me a whole load of time testing out lots of ways to a<a href="http://www.vanessafoxnude.com/2007/05/25/a-social-networking-infusion-of-hope-and-joy-and-requited-love/">ggregate profiles on social networks</a>.</p>
<p>Whilst Diggers tend to bury <a href="http://technosailor.com/98-of-wordpress-blogs-vulnerable/">security warnings</a> as spam, they are never-the-less extremely important, well unless you want Aaron to break into your WordPress account in under 5 minutes. <b>Upgrade Now</b></p>
<p>If you have a couple of hours to spend on your education, John Reese really knows a lot about increasing your <a href="http://www.income.com/blog/2007/05/24/reese-vs-shoemoney-round-1/">income online</a>, so I can&#8217;t think of anyone better to interview Shoemoney. There is a lot to be learnt, think of what it would be like to eavesdrop on a conversation between 2 top earners at a bar during a large convention.</p>
<p>That blog post I think is a <b>landmark for affiliate marketing</b> in more ways than one, as John Reese included a disclosure at the bottom for the affiliate links.</p>
<p>Who knows, maybe he wrote it after coming back from <a href="http://www.income.com/blog/2007/05/24/my-visit-to-payperpost/">lunch with Ted Murphy of PayPerPost</a>.</p>
<p>It is true, in John&#8217;s email newsletters he always declares affiliate links, in fact he highlights them, often asks you to clear your cookies before clicking through, and offers massive bonuses for using his links, but this is something different, and because John is <b>so influential</b> in affiliate marketing, I think this might might cause a lots of changes.</p>

<p>There are already lots of laws in place, not just codes of conduct, which 99% of bloggers ignore every day, so having one more law or code of conduct just doesn&#8217;t cut it either for the owners of a blog, or the people leaving comments.</p>

<li>Disclosure</li>
<li>Terms of Service</li>
<li>Comments Policy (moderation and copyright)</li>
</ul>
<p>It is actually funny that many of the same bloggers who harp on about not needing any form of &#8220;code of conduct&#8221; are the exact same people who think that bloggers who do paid posts should be required to have disclosure in the first line of every article.</p>
<p>Scott Jangro, one of the founders of Bumpzee is a very smart guy, and a few days ago came up with a much better <a href="http://www.jangro.com/a/2007/04/10/dont-be-an-idiot-dbai/">solution to the whole code of conduct debate</a>.</p>

<p>With CSS note that a form is a box element, and if you float a DIV inside containing images, you might need to adjust the z-axis of each element to have items added inside the form to have clickable links.</p>

<h3>WordPress SEO Tips &#038; Hacks</h3>
<p><a href="http://andybeard.eu/2007/03/how-to-setup-email-notifications-to-avoid-your-wordpress-blog-being-suspended.html">Subscribe to Comments Hacks</a> &#8211; I am including this at the top of the list because it is highly important. Emails sent out from your domain could cause you problems with email delivery or spam complaints, and the plugin by default doesn&#8217;t comply with CAN-SPAM if you or someone else (a spammer) includes a marketing message in your emails.<br />
The danger of overloading your server with emails being sent faster than your host allows is also worth thinking about. I know multiple blogs that have problems delivering all subscribed comments and I am sure the owners are not aware of this.</p>
<p>Just imagine you have 20 people comment on a post, and then you get 5 new comments in the space of one hour &#8211; that would put you over the limit on most shared hosting.</p>
<p>Mine are set up to be delivered by Gmail by SMTP &#8211; which email host is going to block Gmail totally?</p>
<p><a href="http://andybeard.eu/2007/03/spam-karma-23-still-the-best-comment-spam-system-for-niche-websites.html">Spam Karma latest release</a>, and I also speculated that I get <a href="http://andybeard.eu/2007/03/is-akismet-a-spam-magnet-plus-a-little-on-trackbacks.html">less spam</a> using it than if I was using Akismet.</p>
<p>My <a href="http://andybeard.eu/2007/02/ultimate-list-of-dofollow-plugins-banish-nofollow-from-comments-and-trackbacks.html">Ultimate List of Dofollow Plugins</a> first published in February still gains links on a daily basis, and has helped convert 100s of people into removing nofollow from their comments and trackbacks.<br />
I have a followup project planned that I will launch within the next week that will provide a way of highlighting blogs that wish to be highlighted as supporting DoFollow.<br />
The page also now includes information on <a href="http://andybeard.eu/2007/03/how-to-remove-nofollow-on-new-blogger-dofollow-on-blogspot.html">how to remove NoFollow from blogs using Blogger</a> and I hope to be able to include detailed Typepad and MoveableType instructions (I know of 3 people working on this)</p>

<p><a href="http://andybeard.eu/2007/03/google-blog-search.html">Tagging and How Tagging Can Help SEO</a> is one of the primary topics of this blog. I have written a lot of posts regarding the benefits of using <a href="http://andybeard.eu/tag/ultimate_tag_warrior">Ultimate Tag Warrior</a> (that is a link to the tag).<br />
My <a href="http://andybeard.eu/2007/03/google-blog-search.html">analysis of the Google BlogSearch Patent</a> didn&#8217;t gain a lot of links from SEO blogs, but then most SEO bloggers don&#8217;t understand the benefits of tagging and are too worried about <a href="http://andybeard.eu/tag/duplicate_content">duplicate content</a> (another tag link)</p>
<p>Do you get <a href="http://andybeard.eu/2007/03/how-to-coax-citations-and-links-from-the-press.html">linked to by the press</a>? I also highlighted <a href="http://andybeard.eu/2007/03/are-yahoo-guilty-of-unethical-plagiarism-with-syndicated-content.html">how bad some press agencies are with linking</a>.</p>
<p>My attack on <a href="http://andybeard.eu/2007/03/multiple-reasons-why-i-loathe-top-commenters-plugins.html">Top Commenters plugins</a> caused some uproar. Why don&#8217;t Aweber and Getresponse offer a decent email subscription to RSS feeds that reports numbers to Feedburner? Anyone who uses their services misses out on the social proof benefit.<br />
They should also offer their own social proof icons for email subscriptions.</p>
<p>In some ways I hate product launch formula style marketing of services. The scarcity factor makes it hard for a potential buyer to make an informed decision despite all the proof.<br />
